The use of private military and security companies (PMSs) goes back to antiquity. However, this practice has gradually disappeared with the emergence of national armies. The privatization of war and the outsourcing of military functions have been more and more in vogue since a few years.

The tasks assigned to private military and security companies (PMSc) are diverse and varied. It goes from logistical support to direct involvement in hostilities. Despite this, PMSc escape international law. Thus, the expansion of the private security market raises some questions of transparency, as of humanitarian and legal nature.

Faithful to its humans and humanitarians principles, Switzerland has grasped the danger of the privatization of war since the 2000s. Switzerland is a pioneer in the promotion of international humanitarian and human rights law to private military and security companies (PMSc).

As a first step, the Federal Council adopted in 2005 a report on private military and security companies (PMSc). This step resulted in the publication of the Montreux Document, jointly conducted by the Swiss Federal Department of Foreign Affairs (FDFA) and the International Committee of the Red Cross (ICRC). The Montreux Document contains good practices to adopt in the field.
